2. When we are a controller, and when we are a processor
2.1 This distinction matters, because it determines who you should contact about your data.
2.2 We are a controller of personal data relating to: visitors to our website; our customers and prospective customers, including course creators who subscribe to our hosting service; and people who buy courses through our platform, because we act as merchant of record for those sales. This policy describes that processing.
2.3 We are a processor of personal data relating to learners which a course creator uploads to, or generates within, our learning management system. In that case the course creator is the controller and decides how that data is used. We process it only on their instructions, under a Data Processing Agreement. If you are a learner on a creator’s course and want to exercise your rights over your learning data, you should contact that creator in the first instance, and we will direct you to them if you contact us.
3. What personal data we collect

We do not seek to collect special category data (such as health or religious beliefs) about our customers, and ask that you do not send it to us unnecessarily.
4. How we use it, and our lawful bases

5. Who we share it with
5.1 We share personal data with the following categories of recipient, who act as our service providers:
5.2 Our website and e-commerce platform provider, which hosts our website and shop.
5.3 Our learning management system provider, which hosts the platform on which courses are delivered.
5.4 Our customer relationship management provider, which stores customer and enquiry records.
5.5 Our payment provider, which processes card payments and transfers course revenue to creators. It acts as an independent controller for some of its own purposes, including fraud prevention and meeting its own legal obligations.
5.6 Our email, hosting and IT service providers.
5.7 Our professional advisers, including accountants and lawyers, where necessary.
a) We may also disclose personal data where we are required to do so by law, or in connection with the sale or reorganisation of our business.
b) We do not sell personal data, and we do not use it to train artificial intelligence or machine learning models.
6. International transfers
6.1 Some of our providers process personal data outside the United Kingdom, including in the European Economic Area and the United States. Our customer relationship management provider, our payment provider and our website analytics provider are among these.
6.2 Where personal data is transferred outside the UK to a country without UK adequacy regulations, we rely on appropriate safeguards, which will usually be the International Data Transfer Agreement or the UK Addendum to the European Commission’s standard contractual clauses, together with a transfer risk assessment where required.

7. How long we keep it

7.1 Learner data held on behalf of a course creator is retained in accordance with our Data Processing Agreement with that creator, and deleted or returned when their subscription ends.
8. Cookies and analytics
8.1 Our website uses cookies. Strictly necessary cookies, which are required for the site to work and for you to log in and check out, are set without consent because the law permits this.
8.2 We use Google Analytics to understand how visitors find and use our website, so that we can improve it. Google Analytics sets cookies that collect information about your visit, including pages viewed, how long you stayed, and general location derived from your IP address. This information is used for statistical purposes and we do not use it to identify you personally.
8.3 Analytics and any marketing cookies are set only where you agree through our cookie banner. You can change or withdraw your choice at any time using the banner, or by deleting cookies in your browser settings. Refusing them will not affect your ability to use our website, buy a course, or access your learning.
8.4 Google Analytics involves a transfer of data outside the United Kingdom. Google provides appropriate safeguards for those transfers, and further information is available in Google’s own privacy documentation.
9. Your rights
9.1 Under UK data protection law you have the right to: be informed about how we use your data; request a copy of it; have inaccurate data corrected; request erasure; restrict how we use it; object to processing based on legitimate interests; request portability of data you gave us; and withdraw consent at any time where we rely on consent.
9.2 To exercise any of these rights, contact us using the details in section 1. We will respond within one month. We do not usually charge, and we may ask you for information to confirm your identity.
9.3 If you are a learner on a course provided by one of our creators, and your request concerns your learning data, please contact that creator, who is the controller of that data.
9.4 We do not make decisions producing legal or similarly significant effects about you based solely on automated processing.
10. Complaints
10.1 If you are unhappy with how we have handled your personal data, please tell us first so that we can try to put it right. You also have the right to complain to the Information Commissioner’s Office at ico.org.uk, by telephone on 0303 123 1113, or at Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.
11. Changes to this policy
11.1 We may update this policy from time to time. The version number and effective date are shown at the top. Where a change materially affects how we use your personal data, we will notify you directly.
